• How can foreigners in Beijing check information about retirement, pensions or the calculation method for retirement?

    According to Article 2 of the Notice on Issuing the "Specific Measures for Implementing the 'Beijing Basic Pension Insurance Regulations'" (Jing Lao She Yang Fa [2007] No. 21)(《关于印发《关于贯彻实施<北京市基本养老保险规定>有关问题的具体办法》的通知》(京劳社养发[2007]21号)), the basic pension is calculated as follows:
    Basic Monthly Pension:
    The standard is calculated based on the average of the city's average monthly wage in the previous year at the time of the insured's retirement and the individual's indexed average monthly contribution wage. For each full year of the insured’s total contribution period (including deemed contribution years, as below), 1% will be granted.

    Monthly Personal Account Pension:
    The standard is determined by dividing the total accumulated savings in the insured’s personal account by the number of months specified in the national calculation table (see Appendix 1).

    Monthly Transitional Pension:
    The standard is the sum of the transitional pension calculated based on deemed contribution years and the transitional pension calculated based on actual contribution years.

  • If an employer terminates a contract early, how can an employee understand their rights and severance pay matters?

    According to Article 87 of the Labor Contract Law of the People's Republic of China (中华人民共和国劳动合同法), if an employer unlawfully terminates or dissolves a labor contract, the employer shall pay the employee concerned the compensation equal to twice the amount of economic compensation specified in Article 47. If a dispute arises between an employee and his/her employer, it is advised to resort to labor arbitration.

  • If a foreigner in Beijing accidentally loses their old passport, how can they use the new passport to check their social security records?

    You can bring a photocopy of your old passport and the original copy of your new passport to the nearest social security authority in Beijing to check and print out the relevant document.

  • How can foreigners get employed in Beijing?

    Foreigners in China can apply for job positions via various legal employment websites based on their personal willingness, education levels, abilities and qualifications, language proficiency levels and other advantages, as well as the market demand. If you have working experience related to medical devices, you can apply for positions in the related domains, based on the market demand and your personal situation. The result of your application is subject to the market employment situation.

    If you meet all the requirements and are deemed needed by the employer, the employer shall apply for a work permit on your behalf, and you shall be employed only after the application for the work permit is approved and you obtain a work permit. 

    Any foreigner applying for a work permit shall meet the following basic conditions: 

    ① The applicant shall be at least 18 years old, with good health and no criminal record. The applicant must have a determined employer in the Chinese mainland, with the necessary professional skills or the appropriate level of knowledge.

    ② The applicant's job must be in line with the needs of China's economic and social development. The applicant shall be a professional talented individual urgently needed by China.

    ③ If laws and regulations provide otherwise regarding foreigners working in China, the relevant provisions shall prevail.

  • How can foreigners apply for a "Tax Payment Certificate"?

    For tax information prior to 2019, taxpayers can go to a tax service hall to apply for a "Tax Payment Certificate" (税收完税证明) (in document format) and an "Individual Income Tax Payment List" (个人所得税纳税清单) through the Golden Tax System (Phase III). (Note: The payment list does not include information about the withholding entities.)

    Foreigners may log in to the Beijing Social Insurance Rights Inquiry Service Platform (https://fuwu.rsj.beijing.gov.cn/zhrs/sbqycx/sbRights/sbRightsHome) to check the individual social insurance records of insured personnel.

  • Should employers hiring foreigners register social insurance for them?

    According to Article 4 of the Interim Measures for the Participation in Social Insurance of Foreigners Employed in China (Decree No. 16 of the Ministry of Human Resources and Social Security)《在中国境内就业的外国人参加社会保险暂行办法》(人社部16号令), employers hiring foreigners must complete social insurance registration for them within 30 days from the date of obtaining their employment permit.
