Things to Know About Complaints and Reports to Beijing's Labor Security Supervision Authorities

A foreign national who, after obtaining a Foreigner's Employment License of the People's Republic of China, may file a complaint with the labor security supervision authority in the location of his/her workplace if he/she believes that his/her legitimate labor security rights and interests have been infringed upon by his/her employer. In this case, a written complaint shall be completed and submitted. If it is genuinely difficult to prepare a written complaint, an oral complaint may be lodged, in which case the supervision authority concerned shall transcribe the oral complaint, and the transcript shall be signed by the complainant. To facilitate communication and enhance the efficiency and quality of the handling procedure, the complainant may bring relevant materials such as his/her Foreigner's Employment License of the People's Republic of China, Chinese Z visa (or Residence Permit for Foreigners in the People's Republic of China) and other necessary documents when filing the complaint.

Q: What are the main contents of a written complaint?

A: 1. It shall state the complainant's name, gender, age, occupation, employer, residence address, and contact information, the name and address of the employer concerned, and the name and position of the legal representative or principal responsible person of the employer concerned; 

2. It shall state the facts regarding the infringement of legitimate labor security rights and interests and the specific cases of the complaint.

Q: What conditions should be met to make a complaint accepted by a labor security supervision authority?

A: 1. The case of violation of labor security laws occurred within two years;

2. There is a clear employer being complained against, and the infringement of the complainant's legitimate rights and interests was caused by the employer's violation of labor security laws;

3. The case falls within the scope of labor security supervision and is under the jurisdiction of the labor security supervision authority receiving the complaint.

Any complaint meeting the aforementioned conditions shall be accepted by the responsible labor security supervision authority according to laws within five working days from the date of receiving the complaint, and shall be registered and investigated on the day of acceptance.

Q: What are the common situations where a labor security supervision authority does not accept a complaint?

A: 1. The case should be resolved through labor dispute resolution procedures;

2. Mediation or arbitration has already been applied for through labor dispute resolution procedures;
3. Labor dispute litigation has already been initiated;

4. The case occurred more than two years ago and therefore falls out of the time frame prescribed for labor security supervision;

5. The case falls outside the duty scope of labor security supervision;

6. The case falls outside the jurisdiction of Beijing's labor security supervision authorities.
