The Measures for Promoting Human Resources Market Development in Beijing Municipality (hereinafter referred to as "the Measures") came into effect on May 1, 2021.

The Measures consist of 35 articles in five chapters: General Provisions, Cultivation of Human Resources Market, Human Resources Services, Supervision and Legal Liability, and Supplementary Provisions.

This is the first government regulation specifically aimed at advancing the development of the human resources market.

Giving Full Play to the Decisive Role of Market in Human Resources Allocation:

By the end of 2020, Beijing had established 2,460 human resources service agencies, facilitating the employment and mobility for over 12 million people.

Establishing and Improving the Human Resources Allocation Mechanism:

Government: Macro-level regulation

Industry: Self-discipline and standards

Market: Fair competition

Employers: Autonomous hiring

Individuals: Free career choices

Human Resources Service Agencies: Ethical services

Including Human Resources Services in the Catalog of High-End, Precision, and Advanced Industries Registration in Beijing:

The Measures propose the establishment of national and municipal-level human resources service industrial parks in Beijing.

This marks the first time human resources services have been included in the Catalog of High-End, Precision, and Advanced Industries Registration in Beijing.

Currently, the output value of Beijing's human resources services industry has reached CNY 300 billion.

Supporting the Development of a National Sci-Tech Innovation Hub and the Construction of "Two Zones":

Opening up the Human Resources Market:

Foreign investors are granted national treatment in accordance with the law.

Foreign investors may establish for-profit human resources service agencies in Beijing independently or jointly with other investors.

Establishing the Recognition Mechanism for Previous Qualifications of Overseas Professionals:

Individuals meeting the criteria under the Catalog of Overseas Professional Qualifications in Beijing may provide services in the city, with their previous overseas work experience recognized as domestic experience.

Encouraging the introduction of urgently needed and scarce talents through headhunting:

For-profit human resources agencies and related employers may receive incentives under municipal regulations for recruiting urgently needed and scarce international talent.  

Protecting Job Seekers' Personal Information in Accordance With the Law:

"Three 'Shalls' and One 'Shall Not'":

Human resources service agencies shall establish a personal information protection system for job seekers and promptly handle complaints and reports related to their personal information security. 

Human resources service agencies and employers shall collect, store, use, process, transmit, provide, and disclose personal information of job seekers in accordance with the principles of legality, legitimacy, and necessity, along with the consent of job seeker's, unless otherwise stipulated by laws and administrative regulations.

Human resources service agencies offering online recruitment services shall implement a monitoring and early-warning mechanism for personal information security of job seekers. 

Human resources service agencies shall not provide the personal information of job seekers to any entity or individual who has not commissioned them to publish job postings.
